Terms of Service

Welcome to Ohenu. Ohenu provides an app discovery platform that aggregates and indexes applications available on Google Play (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

These Terms constitute a binding agreement between you and Ohenu regarding your use of the Service. By using the Service, you warrant that you have the legal capacity to enter into these Terms. If you are acting on behalf of an organization, you warrant you have the authority to bind that organization to these Terms.

2. Changes to Terms

Ohenu may modify these Terms from time to time. We will post the updated Terms on ohenu.com and indicate the effective date. Your continued use of the Service after the revised Terms become effective constitutes acceptance of the changes. If you object to any revised term, discontinue use of the Service.

3. Intellectual Property

All content and features included on the Service, including but not limited to text, graphics, logos, images, design, and the underlying software (the “Ohenu Content”), are owned by Ohenu or its licensors. The Ohenu name, logos, and brand assets are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose in accordance with these Terms. Reproduction, modification, distribution, or creation of derivative works of any Ohenu Content is prohibited unless expressly authorized by Ohenu.

User-submitted content: If you upload or submit content through the Service, you grant Ohenu a worldwide, non-exclusive, royalty-free license to display, reproduce, and distribute that content as part of providing or improving the Service. You retain ownership of your content and you warrant you have the rights to grant this license.

4. Third-Party Links and Apps

The Service may include links to third-party apps that are hosted on Google Play. Ohenu does not host, control, or maintain these apps, nor does it guarantee their availability, functionality, or safety. Access to and use of any linked apps are governed by Google Play’s terms and the respective app developers’ terms and privacy policies. Ohenu bears no responsibility for the content, practices, or data handling of any third-party apps or the Google Play Store. The presence of links does not constitute an endorsement by Ohenu.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” OHENU AND ITS LICENSORS AND SUPPLIERS MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. OHENU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR THAT ANY CONTENT IS COMPLETE OR CURRENT. USE OF THE SERVICE IS AT YOUR OWN RISK.

6. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, OHENU AND ITS AFFILIATES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE FEES, IF ANY, YOU PAID TO ACCESS THE SERVICE IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR AN AMOUNT THAT IS COMMERCIALLY REASONABLE FOR SUCH CLAIMS IF NO FEES WERE PAID.

7. Indemnification

You agree to defend, indemnify, and hold harmless Ohenu and its officers, directors, employees, agents, and licensors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

8. Termination

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that violates these Terms or is harmful to other users, Ohenu, or third parties. Upon termination, your right to access the Service ceases immediately, and you may lose access to any content stored within the Service.

9. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Ohenu operates, without regard to its conflict of laws principles. You and Ohenu agree to resolve disputes through amicable negotiations and, if necessary, in the appropriate courts located in that jurisdiction.
